1. Agreement
By creating an account or using the Wake Club platform ("Service"), you agree to be bound by these Terms of Service. The Service is operated by WakeXscape LLC ("WakeXscape," "we," "us"). If you do not agree to these terms, do not use the Service.
2. Eligibility
- - You must be at least 18 years old to create an account.
- - Participants under 18 may attend sessions only with a parent or legal guardian present who has an active account and has signed the WakeXscape waiver.
- - All session participants must sign the WakeXscape liability waiver before boarding.
3. Accounts
- - You are responsible for maintaining the security of your login credentials.
- - Provide accurate, current information when registering.
- - One account per person. Sharing accounts or credentials is not permitted.
- - We reserve the right to suspend or terminate accounts that violate these terms.
4. Membership Tiers and Credit Packs
- - Basic: Free tier. Pay per session at the published drop-in rate ($135/session).
- - Silver (3-Pack): One-time purchase of $295 for 3 session credits with priority queue access.
- - Gold (6-Pack): One-time purchase of $500 for 6 session credits with top queue priority and a free monthly guest pass.
Credit packs are one-time purchases, not subscriptions. Credits do not expire but are non-transferable between members. Purchasing additional packs adds credits to your existing balance.
5. Session RSVPs and Queue Priority
- - Sessions have limited capacity (typically 6 spots per session).
- - RSVP queue priority: Gold members first, then Silver, then Basic.
- - Within the same tier, priority is determined by response time.
- - RSVPing to a session deducts 1 credit (Silver/Gold) or requires a per-session payment (Basic/out-of-credits).
6. Cancellation Policy
- - Cancellations made more than 24 hours before a session will receive a full credit refund or payment refund.
- - Cancellations within 24 hours of the session ("late cancellations") forfeit the credit or payment.
- - No-shows are treated as late cancellations.
- - WakeXscape reserves the right to cancel sessions due to weather, safety conditions, or insufficient sign-ups. Credits or payments will be restored for operator-initiated cancellations.
7. Guest Passes
- - Silver members may bring one guest per month at a 50% discount on the session rate.
- - Gold members may bring one guest per month at no additional charge.
- - Guests must sign the WakeXscape waiver. The inviting member is responsible for their guest.
8. Safety and Conduct
- - Follow all instructions from the boat captain at all times.
- - No alcohol or controlled substances before or during sessions.
- - Wear appropriate water safety equipment as directed.
- - WakeXscape reserves the right to refuse service or remove any participant who poses a safety risk or disrupts the session.
9. Assumption of Risk and Liability Waiver
Wakesurfing and watersports involve inherent risks including but not limited to drowning, injury, and equipment malfunction. By participating, you acknowledge these risks and agree to sign the WakeXscape liability waiver. To the maximum extent permitted by Florida law, WakeXscape LLC, its officers, employees, captains, and agents shall not be liable for any injury, loss, or damage arising from your participation in Wake Club sessions.
10. Intellectual Property
All content on the Wake Club platform, including design, code, and branding, is the property of WakeXscape LLC or its licensors. You may not reproduce, distribute, or create derivative works without written permission.
11. Modifications
We may update these terms at any time. Material changes will be communicated via email or a notice on the platform. Continued use of the Service after changes constitutes acceptance of the updated terms.
12. Governing Law
These terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Miami-Dade County, Florida.
